Thailand's accession to the Hague Apostille Convention is the single most significant simplification of cross-border document use in Thai legal history. Before 14 February 2024, every Thai document destined for foreign use required a three-step legalisation: certified translation, MFA Department of Consular Affairs legalisation, and finally legalisation at the destination country's embassy in Bangkok. Which Documents Can Be Apostilled in Thailand?
Article 1 of the Hague Convention defines four categories of "public documents" eligible for Apostille: (a) documents emanating from an authority connected with the courts (court rulings, divorce decrees, probate orders); (b) administrative documents (birth, marriage, divorce, death certificates, household registration, ID extracts, name change certificates, police clearances, academic transcripts and degrees from public universities, vehicle registration); (c) notarial acts (any document notarised by a Lawyers Council Notarial Services Attorney); and (d) official certificates placed on private documents (signature certifications, certificate of registration of a document, dating certifications). Private documents — Powers of Attorney, affidavits, statutory declarations, foreign-issued documents — qualify for Apostille only after passing through category (c) via Thai notarisation first.
The Translation Sequence Question — Critical to Get Right
Many applicants and even some lawyers get the translation sequence wrong, causing the Apostille to be effectively useless and forcing a re-do. The correct sequence depends on destination country requirements: Germany, France, Spain, Italy, Belgium, Netherlands generally require the translation itself to be Apostilled, meaning the workflow is original → translation by Sworn Translator (or Beglaubigte Übersetzung) → notarisation of translator's signature → Apostille on the notarisation.
