Why Court-Certified Translation Matters
In Thailand, Section 46 of the Civil Procedure Code requires that any document submitted as evidence in a foreign language must be accompanied by a certified Thai translation. Conversely, Thai documents used in foreign-language proceedings must be translated by a translator whose credentials are recognised by the receiving forum. The Ministry of Justice maintains a central register of translators who have been examined, vetted and authorised to provide such certified translations for use in legal proceedings.
Using a non-MOJ translator for court documents creates significant risk: the opposing party can challenge the translation's admissibility, the judge can order re-translation by an MOJ translator (causing delay and cost), or the document may simply be excluded from evidence.
