What is a Sworn Translator?
The Sworn Translator institution is a continental-European and Latin-American legal tradition that does not exist in common-law countries like Australia, the UK, USA or Canada. In countries that use it, a Sworn Translator (German vereidigter or beeidigter Übersetzer; French traducteur assermenté or traducteur expert; Spanish traductor jurado; Italian traduttore giurato; Portuguese tradutor ajuramentado; Polish tłumacz przysięgły; Brazilian tradutor juramentado) has formally sworn an oath before a court or government ministry to translate accurately and impartially. The oath gives their translations the same legal weight as a notarial act. Registry offices, courts, universities, ministries of foreign affairs and other state authorities accept Sworn translations without further legalisation.
This is materially different from NAATI (the Australian standard), Notary Public certification of a translator's signature (the US/UK practice), or simple "certified translation" (a vendor's self-certification). For destinations that require Sworn — Germany's Standesamt, French Mairie, Spanish Registro Civil, Italian Comune, German universities filing through uni-assist with Anabin database — only a translator listed on the relevant court register satisfies the requirement. Submitting a NAATI or non-Sworn translation will result in rejection.
The Most Common Sworn Translation Use Cases
Marriage abroad in continental Europe. A Thai citizen marrying in Germany, France, Spain, Italy, Portugal, Belgium, Netherlands or Switzerland needs the German Standesamt, French Mairie, Spanish Registro Civil, etc. to accept their Thai birth certificate, household registration, ID card, name change certificates and Certificate of No Impediment. All five categories must be Sworn translated by a translator registered with the local court. Without Sworn translation the wedding cannot proceed.
German university admission. The uni-assist application portal for international students requires academic transcripts and degree certificates to be translated by a vereidigter Übersetzer registered in Germany. Translations done in Thailand by NAATI translators are explicitly rejected. The Anabin database used by German universities to evaluate foreign credentials cross-references the Sworn translator's certification.
Spousal residence permits in Schengen states. Bringing a Thai spouse to live in Germany, France, Spain or Italy requires Sworn-translated marriage certificates, divorce decrees from prior marriages, birth certificates of children, and police clearances.
Court proceedings in EU member states. Thai court rulings, divorce decrees, probate orders, custody orders submitted to a German, French, Spanish or Italian court require Sworn translation. Apostille on the original and on the Sworn translation is generally required.
Brazilian visa and residence. Brazilian Federal Police processing of permanent residence applications based on marriage to a Brazilian national requires tradutor juramentado translations of all Thai civil documents, with Apostille on the original.
