Marrying a Thai Citizen in Thailand — The Complete Guide for Foreigners

A marriage registered in Thailand between a foreign national and a Thai citizen is one of the most internationally portable marriage records in the world. Conducted under Section 1457 of the Thai Civil and Commercial Code at any of Thailand's 928 District Offices (Amphurs), the marriage produces two formal certificates — Kor.2 (the registration record) and Kor.3 (the marriage certificate) — that are recognised across all Hague Apostille Convention members (since Thailand joined on 14 September 2025), all bilateral-treaty partners, and effectively every visa-issuing immigration authority worldwide. Step 1 — Embassy Affidavit of Freedom to Marry

Thai law requires that any foreigner marrying in Thailand prove they are legally free to marry — i.e. not currently married elsewhere. This proof comes from the foreigner's own embassy in Bangkok in the form of an Affidavit of Freedom to Marry (also known as a Single Status Affidavit, Statutory Declaration in Lieu of Certificate of Non-Impediment, or no-impediment letter — terminology varies by country).

Each embassy operates differently. The U.S. Embassy on Wireless Road requires the foreigner to swear the affidavit in person before a consular officer (USD 50, appointment via embassy website, typically 5-10 business days lead time). The British Embassy on Wireless Road handles Notice of Marriage applications (GBP 50, by post or in person). The Australian Embassy on South Sathorn Road executes a Statutory Declaration (ask our team for rates walk-in service Tuesday-Thursday 9-11 am). The Embassy of Germany requires the foreigner to first obtain an Ehefähigkeitszeugnis from the German registrar (Standesamt) in their German municipality of last registration, then have it apostilled in Germany before presenting it to the German Embassy in Bangkok. The Embassy of France issues a Certificat de Coutume + Certificat de Célibat package on appointment (EUR 50). The Embassy of Japan, the Embassy of South Korea, the Embassy of the Philippines and the Embassy of Vietnam all have similar but specific requirements.

Step 2 — Thai Translation by NAATI/MFA-Recognised Translator

The embassy affidavit is issued in the foreigner's language (English, German, French, Japanese, Korean, etc.). The Amphur and the Thai MFA both require a Thai translation. The translation must be performed by a translator recognised by the Thai Ministry of Foreign Affairs Department of Consular Affairs — informally referred to as the "MFA list" — or by a NAATI Certified translator working in the relevant language pair. Step 3 — MFA Legalisation / Apostille

The translated affidavit must then be legalised by the Thai Ministry of Foreign Affairs Department of Consular Affairs at Government Complex, Chaeng Watthana, Bangkok. As of 14 September 2025 Thailand became a full member of the Hague Apostille Convention, so for use within Thailand the document carries either a Thai MFA legalisation stamp (traditional route) or an Apostille (new route, recognised in 125 countries for the eventual onward use of the resulting marriage certificate). Step 4 — Amphur Registration

With the legalised affidavit in hand, the couple — both parties physically present — attends the chosen Amphur with their two witnesses.
